1.1 Megapixel Entertainment Ltd, company registration number C 42051, Level 2, 14 East, Triq ir-Rebha, Gzira GZR1327, Malta (the "Gaming Operator") offers games on the website www.hyperino.de (the "Website"). The terms and conditions apply solely in relation to the use of this website and not in relation to other websites of the gaming operator.
1.2 The Gaming Operator is licensed and regulated in Malta by the Malta Gaming Authority ("MGA") and this Site is on the basis of the following gaming licenses (collectively the "Gaming License") issued and regulated by the MGA. Gaming Services Licence (MGA/B2C/906/2021 -- issued 24 January 2022)
1.3. Regardless of the game, your player contract is solely with Megapixel Entertainment Ltd. 2.1 In order to use the Gaming Operator's services, the Player must open an account (a “Player Account”). Only one player account per player is allowed at Hyperino and players must register personally. The Gaming Operator reserves the right to refuse a player the requested player account.
2.2 If you open or attempt to open more than one player account at Hyperino for any reason whatsoever, the gaming operator is free to close any or all of your accounts. In any case, the gaming operator will first freeze all your accounts and conduct internal investigations to determine whether there is any suspicion of fraud and/or money laundering. If the gaming operator comes to the conclusion that there is a suspicion of illegal behavior, the gaming operator reserves the right to close all of your accounts and freeze your funds initially and only pay them out in consultation with the responsible law enforcement authorities. If the gaming operator comes to the conclusion that there is not sufficient suspicion of illegal conduct, the gaming operator can, after obtaining the consent of the management, decide to keep an account open. In this case, Megapixel will leave open the first player account you opened with the game operator and close all other player accounts you have. The funds in the Multiple Accounts will be returned to your Payment Account by the Gaming Operator, which you used to make deposits into the Multiple Accounts. 2.3 The Player (which in this case includes any person who wishes to be accepted as a Player) must always provide the Gaming Operator with valid, complete and correct information. 2.4 The Gaming Operator carries out Know Your Customer (KYC) procedures to uniquely identify the players and to verify their identity. Gaming Operator is entitled to carry out the identification and other verification procedures required by applicable law and regulations or by the relevant regulatory authorities for the use of the website. 2.5 In relation to depositing and withdrawing funds into and out of your Player Account, you are only permitted to use means of payment which are valid and lawfully owned by you - i.e. in your own name. 2.6 All transactions must be verified to prevent money laundering. The gaming operator must report any suspicious transactions to the relevant authorities. 2.7 In order to open a Player Account with the Gaming Operator, the Player must complete the relevant online registration form and provide the Gaming Operator with at least the following information: (a) Player's full name and address (b) Player's date of birth, (c) Player's place of birth, (d) Player's maiden name, if applicable, (e) Player's nationality, (f) a valid email belonging to the Player address or telephone number;
2.8 (a) After the registration form has been sent, the first step is to check for duplicates (for the prohibition on multiple registrations, see Section 2.2 above). If a player account already exists with the same combination of surname, first name and date of birth, the registration will be rejected.
(b) Simultaneously with the duplicate check, Megapixel checks whether the player is a politically exposed person (“PEP”) and whether he or she is on a sanctions list (“SL”).
In the event of a PEP hit, the data of the person registering but provisionally identified as a PEP is escalated to the management of Megapixel. This first checks, if necessary on the basis of additional documents to be submitted, whether the newly registered person is actually a PEP or whether a false positive hit occurred. In the latter case, Megapixel readily releases the player account for identity verification. If the newly registered person is actually a PEP, the management, in consultation with the money laundering officer, decides whether or not to enter into a business relationship with the PEP. (i) If the management makes a positive decision, Megapixel will activate the player account for identity verification and will also take special anti-money laundering measures to carry out increased “know-your-customer” due diligence. Customer service will request additional documents for this purpose, in particular proof of the source of funds and the financial situation of the PEP, which the PEP must then email to customer service within a period specified by customer service. (ii) If the decision of the board of directors is negative after consultation with the money laundering officer, Megapixel refuses to activate the player account for identity verification and cancels the registration. Doing business with anyone on a sanctions list is prohibited by law. Therefore, Megapixel terminates the registration process if the person registering is on such a list. - ID-verified identity (= Q-Bit) The "key issues paper Internet requirements according to § 4 paragraph 5 GlüStV" of August 8th, 2018 does not provide for a check of the address as part of the "SCHUFA Identity Check Premium (Q-Bit)". Nevertheless, the game operator uses the data on the player's address that may be made available by the Schufa and defines a minimum hit quality of 75%. This means that the player can deposit up to a maximum of €100.00 using payment accounts that are clearly assigned to him, and that he can play for a maximum of 72 hours. (f) Another way to verify your identity is via the bank account and the ID check using the Klara-Sofort or GiroPay ID procedures approved by the KJM. With both options, the player must log into his online banking account with his access data. After successfully logging in, the player confirms his identity using the bank-dependent confirmation procedure, which usually also allows transfers (e.g. push TAN, SMS TAN, etc.). Now the comparison of the player data with the data of the bank account holder takes place in order to verify the identity beyond a doubt. (g) Finally, it is also possible to confirm the identity using the video identification process. The player must first photograph or scan the front and back of his qualified identification document and upload it to the Hyperino website. The Megapixel then uses AI to check the authenticity of the document. After that, the player has to take a selfie with his camera (e.g. mobile phone camera, webcam, etc.), whereby a live detection takes place in order to prevent the photographing of pre-existing pictures or the ID photo. Megapixel then compares the biometric data of the selfie taken with a live ID with the biometric data of the ID photo. If the test is positive, the provisional game ends,

2.9 When you open your player account, the e-mail address you provide will be used as your username and you can choose an individual password. Once your player account has been opened, you must ensure that the username and password remain secret. Your player account credentials should never be written down or given to any other person. We recommend that you change your password regularly (at least every four weeks). You are solely responsible for the use of your user data. All transactions made under your username and password will be considered valid and self-authorized. We cannot be held liable for any refund claims and therefore will not issue refunds if you provide or have provided your data to third parties in the past. You are solely responsible for protecting the confidentiality of your password and you are responsible and liable for all activities conducted using your username and password.
2.10 If you lose or forget your username and/or password, please follow the instructions on the website regarding how to recover your password or contact our customer service using the contact details provided on the website.
2.11 Players shall not permit any other person to use their Player Account to access or use any material or information from the Gaming System, collect any prize or participate in any of the Games. Sale, transfer and purchase of one's own player account or other player accounts is strictly prohibited.
2.12 The player account is not a payment account i. s.d. Payment Services Supervision Act (ZAG), but a commercial clearing account on which debit and credit positions (money inflows and outflows) are shown. It serves to make all your transactions transparent and traceable and to document your payment flows in a verifiable manner.
2.13 Inactive and Dormant Accounts: (a) If you have not logged into your account for a period of 12 consecutive months, your account will be deemed inactive (“Inactive Account”). When calculating the period of inactivity, such periods are not taken into account for which a player has applied for a player ban due to self-exclusion or for which a third-party ban existed. We charge an administration fee of €5 (“Inactivity Fee”) per month for an inactive account, starting at the end of the first month that the account was considered inactive. We will give you at least thirty (30) days' prior notice before we begin charging your account for the inactivity fee. Among other things, we offer you the opportunity to withdraw the funds in your account (subject to the conditions set out below). The inactivity fee will only be charged as long as (i) the inactive account has a balance or (ii) the account is not reactivated by logging in. You can reclaim the inactivity fees charged if you were unable to use your player account at Hyperino due to health-related impediments. We may require you to provide sufficient evidence of the medical condition preventing you before refunding you the Inactivity Fees. (b) If there is no activity on your Player Account for more than 24 months, the Account will be considered dormant. We will transfer any funds in your Player Account to the bank account specified in your Player Account. If no bank details are entered on your player account or if the bank details provided are no longer correct, we will make every reasonable effort to pay you the money. If we are unsuccessful, the money will be donated to a non-profit organization dedicated to preventing and caring for gambling addicts, provided no claims are made against us. Megapixel asks the non-profit organization to issue you with a donation receipt and send it to you by post.
Prohibition of Parallel Game
3.1 The new GlüStV 2021 prohibits parallel participation in games. You are therefore not entitled to use the games offered on the Hyperino website if you are logged in to another online gambling provider and are participating in their online gambling offerings.
3.2 To prevent parallel gaming, the GlüStV provides for a central activity file to which all online gaming providers must connect. Before we can allow you to participate in a game, we are obliged to transmit your full name, date of birth, place of birth and address to the activity file in order to query whether you are already active with another online gambling provider. If there is no feedback that you are already active with another online gambling provider, you will be entered in the central activity file as active on hyperino.de. If you end your participation in the game with us, we report this to the central activity file, also stating the aforementioned data. The GlüStV stipulates a waiting period of five minutes between the activation of the first online gambling provider and the second online gambling provider. 4.1 In order for you to be able to use the paid services offered on the website, you must first deposit funds into your player account by Hyperino. 4.2 We are obliged to tell you how we hold your money and the extent to which your funds are protected in the event of insolvency. We manage the money you deposit and arrange the necessary transactions for you to be able to use the services offered on the website. The money you deposit and your winnings are held by us in a segregated, escrowed, no-charge, no-charge bank account for player funds only, separate from our other assets. Your balance in your player account remains your property until you use it to participate in a game and we deduct this stake from your player account.
4.3 The GlüStV 2021 only allows the euro as the currency in which the player account is managed. We are therefore obliged to report your balances and all your transactions in euros and cents.
4.4 According to § 6c paragraph 1 GlüStV there is a deposit limit for all providers. Megapixel therefore asks you when you register your player account at Hyperino to set an individual monthly cross-provider deposit limit - i.e. a limit on the amount that you can deposit into your player accounts with online gambling providers every calendar month - or to state that an already defined individual monthly cross-provider deposit limit should be retained unchanged. As long as no provider-independent deposit limit has been set for a game participant, no game participation may be permitted. This individual, cross-provider monthly deposit limit must not exceed EUR 1000 per month. To monitor compliance with the monthly cross-provider deposit limit, the supervisory authority responsible for this maintains - namely until December 31, 2022 the State Administration Office of Saxony-Anhalt, Department 208, in Halle an der Saale, and from January 1, 2023 the joint gaming supervisory authority (GGA) in Halle an der Saale – a central limit file. Megapixel is obliged to transmit your first and last name, your maiden name, your address, the deposit limit across providers, the date the limit was set, and the amount and date of the deposits made to this central limit file for their release. 4.5 A player can access his player account immediately after verification. A player can place bets as soon as he has access to the funds in the player's account. All deposits are made in real-time and when successfully completed, they are instantly credited to the player's account. All deposits are irreversible.
4.6. The Gaming Operator will not accept a player's wager until there are sufficient funds in the player's account to cover the amount of the wager. The gaming operator reserves the right to refuse or limit any wager. The Gaming Operator does not grant any credit to the Player and the Player cannot use accidentally credited amounts as wagers.
4.7 The player acknowledges that there is a risk of losing money when playing on the website and the gaming operator accepts no liability whatsoever for such losses. The player is also aware that the gaming operator is not a financial institution. Neither deposits nor winnings bear interest, which means that players do not receive any interest on the balance in the player account. Players may not make transfers between players or between different player accounts.
4.8 Funds deposited into a player's account must be used as wagers on the games on the website. It must be wagered at least once before a withdrawal can be initiated. An exception to this principle applies only in the event of a complete closure of the player account. All wagers made are binding on the player and cannot be cancelled.
4.9 The gaming operator endeavors to ensure the full protection of all players and their stakes as far as possible. 4.10 According to the payment methods and fees described on the website www.hyperino.de/faq, there is a minimum amount for each individual transfer to a player account ("Minimum Deposit Amount"). If a transfer is initially accepted and thus also displayed on the player's account and the payment service provider later informs the gaming operator that the transfer should be reversed for any reason, the gaming operator will temporarily close the player's account on suspicion of fraud.
4.11 The financial institutions, banks and other third party payment processors may charge a fee for processing payments (“Third Party Payment Service Fees”). The player is obliged to pay any fees from third party payment services.
4.12 Gaming Operator monitors all wagers and account transactions. It is forbidden and unlawful to deposit ill-gotten gains. Therefore, all transactions are checked to prevent money laundering and all suspicious transactions are reported to the gaming operator's Money Laundering Officer (MLRO), who reports to and advises the relevant authorities.
4.13 A player may at any time log into their account and view a statement of their player account showing transactions such as deposits, wagers, winnings and withdrawals made on the player's account. If the player encounters errors, he must notify the gaming operator immediately so that the error can be corrected. The player must report such error within 90 days of the error first appearing on the statement available through the website.
Mandatory Break After One Hour
